DENZEL COSTON, PLAINTIFF-RESPONDENT, v. CITY OF BUFFALO, CITY OF BUFFALO POLICE DEPARTMENT AND ADAM M. WIGDORSKI, DEFENDANTS-APPELLANTS.


PRESENT:

Appellants having moved for permission to file a replacement brief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 17, 2017,

Now, upon reading and filing the affirmation of David M. Lee, Esq., dated October 18, 2017, the affidavit of Jeremy Slyck sworn to October 18, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and appellants shall file and serve the replacement briefs, in accordance with the Court's rules, on or before December 6, 2017, and, It is further ORDERED that respondent shall file and serve a brief, in accordance with the Court's rules, on or before January 5, 2018, and

It is further ORDERED that reply briefs, if any, shall be filed and served on or before January 22, 2018.
