Charlotte COSTLEY, Appellant v. Victoria CLARK and National Interstate Insurance Co., Appellees

From the 170th District Court, McLennan County, Texas

Trial Court No. 2013-1228-4 1

Honorable Jim Meyer, Judge Presiding

ORDER

On November 7, 2013, appellant filed a document entitled appellant's brief; however, the document is formatted as a trial court petition. Rule 38.1 of the Texas Rules of Appellate Procedure governs the format of an appellant's brief which must include the following sections: (1) identity of parties and counsel; (2) table of contents; (3) index of authorities; (4) statement of the case; (5) any statement regarding oral argument; (6) issues presented; (7) statement of facts which must be supported by record references; (8) summary of the argument; (9) argument which must contain appropriate citations to authorities and to the record; and (10) prayer. TEX. R. APP. P. 38.1. Because the brief filed by appellant does not comply with Rule 38.1, the brief is STRICKEN. Appellant must file a brief in compliance with Rule 38.1 no later than thirty days from the date of this order.
