ORDER GRANTING PLAINTIFF'S MOTION TO REMAND AND DENYING AS MOOT PLAINTIFF'S MOTION TO REOPEN DISCOVERY


Before the court are plaintiff's motion to remand the Mark Corrinet matter based on lack of subject matter jurisdiction and motion to reopen discovery. Having reviewed the moving papers and defendant's opposition, I have concluded that there is no need for oral argument and VACATE the hearing scheduled for October 1, 2003. It is HEREBY ORDERED that plaintiff's motion to remand is GRANTED and that Mark. Corrinet v. California Movers Express, et al., C-01-4302 BZ shall be remanded to the Alameda County Superior Court. In light of the remand, it is FURTHER ORDERED that plaintiff's motion to reopen discovery is DENIED AS MOOT.
