This case was called and recalled from the Court's trial session on May 16, 2022, in New York City, New York. On May 10, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. On August 16, 2022, the Court received from the parties a Proposed Stipulated Decision in which the Court intends to enter into the record.

Upon due consideration and for cause, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed on May 10, 2022, is hereby denied as moot.
