ORDER


On July 19, 2004, this case was transferred from the docket of the Honorable Sidney A. Fitzwater to the docket of the Honorable Jane J. Boyle pursuant to Special Order No. 3-237. As a result, the Court vacated the remaining trial and pretrial deadlines until it had an opportunity to review the pending dispositive motions. Having now ruled on the dispositive motions, the Court ORDERS as follows:

• The Court DENIES without prejudice Plaintiff's Motion to Exclude the Expert Testimony of Alan J. Blocher (doc. 36), filed June 1, 2004. This Court's rulings on the parties' motions for summary judgment appears to impact the necessity or relevance of Blocher's proposed testimony. Therefore, the Court ORDERS the parties to confer on what portions of Blocher's testimony Fairbanks intends to offer. To the extent Corporate Link believes a Motion to Exclude is still necessary, it must file such motion by May 20, 2005. If appropriate, Corporate Link is permitted to simply refile the Motion to Exclude it filed on June 1, 2004; however, if this Court's rulings have impacted the scope of Blocher's testimony, the Court will require a new Motion.
• The Court also ORDERS the parties to confer and submit to the Court a list of proposed trial dates during August, September, and October 2005 when both parties are available for trial. The parties must submit this list to the Court by May 6, 2005.
SO ORDERED.
