On September 24, 2024, we ordered the trial court to sign a certification of the defendant's right of appeal on or before October 9, 2024. We further ordered the trial court clerk to file a supplemental clerk's record containing the trial court's certification within ten days of the trial court signing the certification. On October 25, 2024, the trial court clerk filed a notification of late record seeking an extension because the trial court has not signed the certification of defendant's right to appeal.
"The trial court shall enter a certification of the defendant's right of appeal each time it enters a judgment of guilt or other appealable order other than an order appealable under Code of Criminal Procedure Chapter 64." Tex.R.App.P. 25.2(a)(2).
Accordingly, we order the trial court, to sign a certification of the defendant's right of appeal on or before November 15, 2024. We further order the trial court clerk to file a supplemental clerk's record containing the trial court's certification within ten days of the trial court signing the certification. We deny as moot the trial court clerk's request for an extension.
Because "[t]he trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed," Tex .R. App. P. 35.3(c), we further order the clerk of this court to serve a copy of this order on the trial court.
