Diane Elizabeth "Betsy" Cornwell, Appellant v. Walden Hagelman, Andie Haddad, and Dana Havlin, Appellees

FROM THE 53RD DISTRICT COURT OF TRAVIS COUNTY NO. D-1-GN-23-000368, THE HONORABLE MARIA CANTU HEXSEL, JUDGE PRESIDING

Before Chief Justice Byrne, Justices Kelly and Theofanis

MEMORANDUM OPINION

DARLENE BYRNE, CHIEF JUSTICE

Appellees Walden Hagelman, Andie Haddad, and Dana Havlin sued Appellant Diana Elizabeth "Betsy" Cornwell. Cornwell filed a plea to the jurisdiction and, after the trial court's denial of that plea, filed this interlocutory appeal. On August 30, 2023, the parties informed this Court of Cornwell's death. At Appellees' request and with the agreement of counsel for Cornwell, this Court by Order dated October 6, 2023, abated this appeal and remanded this cause to the trial court so that Appellees could nonsuit their claims and render this appeal moot.

This Court's clerk obtained a supplemental record from the trial court containing Appellees' Notice of Nonsuit, filed October 17, 2023, nonsuiting all of their claims in this cause. On its own motion, this Court reinstates this appeal and dismisses it as moot.

Dismissed as Moot.
