On March 18, 2024, appellant Russell Cormier filed a notice of appeal from the convictions in trial court case number 1549218 and 1548048. His appeals were assigned appellate case numbers 01-24-00227-CR and 01-24-00228-CR, respectively. In each of his appeals, on April 26, 2024, appellant, acting pro se, filed a "Motion to Moot Murder Indictment Charges Due to Predisposed Mental Illness/Psychosis Medical Issues." In his motion, appellant requests that this Court "moot" the "murder indictment charges" against him due to his "mental illness and PTSD issues."
Appellant's motion, requesting that the Court "moot" the criminal charges against him, requests relief that this Court cannot grant a party by motion. See generally Tex. R. App. P. 10. Accordingly, appellant's motion is denied.
Further, on April 29, 2024, in each of his appeals, appellant, acting pro se, filed a "Motion for Speedy Trial." Appellant's motion for speedy trial notes that he has been incarcerated since his original arrest on April 21, 2017, and "has been so confined" since his arrest and "has at all times been ready for trial." Accordingly, appellant requested that he be permitted a "speedy trial." Appellant's motion for speedy trial, filed in this Court on April 29, 2024, is dated by appellant as July 10, 2019, and bears a file-stamp of the Harris County District Clerk of August 29, 2019.
This Court's records reflect that the trial court entered a judgment of conviction with respect to each of appellant's underlying trial court case numbers on March 18, 2024. Therefore, this Court cannot grant appellant the relief requested in his motion for speedy trial. Accordingly, appellant's motion for speedy trial is denied.
