On September 11, 2024, this Court granted the State's request to set an execution date for Joseph Corcoran, with the execution scheduled for December 18, 2024. On December 5, 2024, a majority of the Court denied motions to stay the execution in case number 24S-SD-222.

Also on December 5, Corcoran's counsel appealed two trial court orders dated December 2, 2024 denying motions for relief under Trial Rule 60(B). On December 6, Corcoran's counsel filed a motion to stay the December 18 execution while this appeal is being litigated.

Being duly advised, the Court ORDERS the State to file a response to the "Motion for Stay of Execution" no later than 12:00 p.m. on Monday, December 9, 2024. No extensions of time shall be granted absent extraordinary circumstances, and no reply brief will be permitted.
