Appeal from Circuit Court, Duval County; Thomas J. Shave, Judge.

Herman Ulmer, Jr. and Gary B. Tullis, of Ulmer, Murchison, Ashby Ball, Jacksonville, for appellant.

Thomas M. Donahoo, of Donahoo, Rowe Donahoo, Jacksonville, for appellee.

We have studied the briefs, received oral argument and examined the record in this case, which was tried by the court without a jury. We find that the court's decision is supported by substantial competent evidence and that there was no error.
