ORDER
Jay Sandon Cooper filed a "Motion to Join Case Number 10-03-283-CV" with the present cause. Cooper requests that the Appellate Court Clerk provide him with the Clerk's Record filed in Cause No. 10-03-00283-CV so that he can reference that record in the present case. His motion is granted in part and denied in part.
The plenary power of this court in Cause No. 10-03-00283-CV has expired. Accordingly, Cooper's motion to join the cases is denied. However, because the two appeals involve facts and issues that arose from the same overall trial court proceeding, we grant Cooper's motion to include the Clerk's Record in Cause No. 10-03-00283-CV in this appeal. Thus, we authorize and direct the Clerk to transfer the Clerk's Record in Cause No. 10-03-00283-CV to this cause and file same herein to be considered as part of the record in this cause.
All references to the Clerk's Record and Supplemental Clerk's Record transferred from Cause No. 10-03-00283-CV shall be indicated as "I CR" and "CRS" respectively and all references to the Clerk's Record from the present cause shall be indicated as "II CR."
Cooper also filed a "Motion to Extend the Time to File Appellant's Brief." This motion to extend is granted. Appellant's brief is due February 20, 2006.
