ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on March 27, 2003, the court determines that the findings and conclusions of the United States Magistrate Judge are correct. The findings and conclusions of the United States Magistrate Judge are hereby accepted by the court. The court denies Petitioner's Writ of Habeas Corpus, and dismisses this action without prejudice for lack of jurisdiction.

It is so ordered
