347 So. 2d 144 (Fla. Dist. Ct. App. 1977)

Opinion

No. 77-321.

June 24, 1977.

Interlocutory Appeal from Circuit Court, Sarasota County; Robert E. Hensley, Judge.

Jeffrey G. Wood, Icard, Merrill, Cullis, Timm Furen, P.A., Sarasota, for appellants.

Michael R. Karp, Wood, Whitesell Karp, P.A., Sarasota, for appellee, Burzenski Nursing Home, Inc., and Roy A. Chapman, Sarasota, for appellee Ms. Burzenski.

The interlocutory order of the court below, denying the appellant's motion to compel the appellee, Ms. Burzenski, to execute a release, is affirmed. However, we do not pass on the merits of any defense such as estoppel, which the appellant may assert in any action which Ms. Burzenski may bring to recover on her claim.

HOBSON, Acting C.J., and McNULTY and GRIMES, JJ., concur.
