Coons v. Shriver

District Court of Appeal of Florida, Second District
Apr 11, 1983
429 So. 2d 27 (Fla. Dist. Ct. App. 1983)

Opinion

No. 82-1685.

February 11, 1983. Rehearing Denied April 11, 1983.

Appeal from Circuit Court, Highlands County; Richard A. Bronson, Judge.

Clifford M. Ables, III, Sebring, for appellants.

Michael J. Trombley of Trombley, Matheny Schommer, Sebring, for appellees.

The trial court erred in awarding appellees' attorney's fees and costs because they neither pled nor proved their entitlement to such an award. We, therefore, reverse that portion of the final judgment. In all other respects, we affirm the trial court.

AFFIRMED in part, REVERSED in part.

HOBSON, A.C.J., and RYDER and CAMPBELL, JJ., concur.
