The common law rule against perpetuities requires that an interest must vest, if at all, within twenty-one years of the death of a life in being when the interest was created. Coomler v. Shell Oil Co., 108 Or.App. 233, 235 n 1, 814 P.2d 184 (1991), rev den, 312 Or. 589 (1992). The trial court concluded that the ROFR agreement violated that rule and was therefore void.
