MEMORANDUM OPINION


The Court has before it appellee's August 18, 2009 motion to dismiss the appeal due to appellants' failure to file their brief. Appellants did not respond to the motion.

The record reflects that on July 13, 2009, this Court sent appellants a letter informing them their brief was overdue. We directed appellants to file, within ten days of the date of the letter, both their brief and a motion to extend time to file the brief. We further warned that failure to comply would result in dismissal of the appeal. Appellants did not file their brief or otherwise correspond with the Court regarding their appeal. Accordingly, we grant appellee's motion to dismiss.

We dismiss the appeal. See Tex. R. App. P. 38.8(a)(1), 42.3.
