Appellate Term of the Supreme Court of New York, First Department
Nov 16, 2005
2005 N.Y. Slip Op. 51841 (N.Y. App. Term 2005)

Opinion

570250/05, 05-165.

Decided November 16, 2005.

Plaintiff appeals from an order of Civil Court, New York County (Peter H. Moulton, J.) entered January 20, 2005, which, inter alia, granted defendant's motion to vacate a default judgment.

Order (Peter H. Moulton, J.), entered January 20, 2005, affirmed, with $10 costs.

PRESENT: Suarez, P.J., Davis, Schoenfeld, JJ.

The motion court properly vacated defendant's short-lived default upon a sufficient showing of a reasonable excuse and meritorious defenses to the CPLR 3213 motion-action ( see Guilden v. Baldwin Sec. Corp., 189 AD2d 716; cf. Buchar v. Sawyer-Ferguson-Walter Co., 247 AD2d 247).

This constitutes the decision and order of the court.
