MODIFICATION ORDER

[NO CHANGE IN JUDGMENT]

The slip opinion filed April 17, 2003, is modified in the following particulars:

1. On page 2, paragraph 3, line 3, the word "Carrying" shall be changed to "Carriage".

2. On page 5, line 3, the word "Carrying" shall be changed to "Carriage".

3. On page 6, paragraph 2, line 1, after the word "adjudication" insert the word "motion".

4. On page 10, paragraph 2, line 3, the word "defendant" shall be changed to "plaintiff".

5. On page 10, paragraph 2, lines 14-15, delete the following: "Orig. italics, fns. omitted, Aguilar v. Atlantic Richfield Company, supra, 25 Cal.4th at pp. 850-851". In its place, insert: "Aguilar v. Atlantic Richfield Company, supra, 25 Cal.4th at pp. 850-851, orig. italics, fns. omitted".
