Opinion

Gen. No. 43,830. (Abstract of Decision.)

Opinion filed January 6, 1947 Released for publication January 20, 1947

APPEAL AND ERROR, § 1394when Appellate court would presume that orders of trial court were properly entered. Upon appeal from order denying defendants' motion to vacate decree entered in foreclosure proceeding and also from subsequent order denying motion to vacate prior order, where no report of proceedings before trial court on entry of two orders was before Appellate Court and it knew nothing of contents of certain papers received in evidence except what was stated in orders, Appellate Court would presume that action of trial court was proper and affirm orders, in absence of report showing to contrary.
