KATHY ANN CONSOLINO v. CURTIS DUANE YOUNG

LC No. 2018-005059-DC

ORDER

Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED IN PART for lack of jurisdiction. Specifically, the claim of appeal is dismissed as to all portions of the September 4, 2024 order, except that portion assessing $590 dollars in attorney fees. The September 4, 2024 order is final only to the extent it is a postjudgment order awarding attorney fees, MCR 7.202(6)(a)(iv); and, the appeal is expressly limited to the portion of the order awarding those fees, MCR 7.203(A). No court rule or statute provides an appeal of right from the other portions of the September 4, 2024 order. If appellant wishes to appeal portions of the order other than the attorney fee portion, he may file a late appeal of those portions under MCR 7.205(A)(4), provided such a filing meets all requirements under the Court rules and is not time barred.

The motion to waive fees is GRANTED for this limited appeal only.

The motion to expedite is DENIED.

The motion to waive the requirements of MCR 7.209(A) is DENIED.
