Connole v. Karpati

Supreme Court of Florida
Feb 16, 2011
56 So. 3d 765 (Fla. 2011)

Opinion

No. SC11-224.

February 16, 2011.

Lower Tribunal No(s). 2005-34769-FMCI, 2009-34751-CICI, 2010-32772-CICI.

The petitioner has filed a petition for writ of habeas corpus with the Court. To the extent the petitioner seeks review of the circuit court's order denying his motion for judicial disqualification, the petition is hereby dismissed without prejudice. To the extent the petitioner seeks additional relief, the petition is denied as successive. See Jenkins v. Wainwright, 322 So. 2d 477, 478 (Fla. 1975) (declaring that once a petitioner seeks relief in a particular court by means of a petition for extraordinary writ, he has picked his forum and is not entitled to a second or third opportunity for the same relief by the same writ in a different court).

PARIENTE, LEWIS, QUINCE, POLSTON, and PERRY, JJ., concur.
