AUTOMOBILES AND MOTOR VEHICLES, § 80.4guest passenger, sufficiency of evidence to show status. Where plaintiff was riding in the automobile of defendant real estate broker, the parties were going to inspect plaintiff's property, but evidence of plaintiff was that defendant did not represent him as his broker, the evidence showed that plaintiff was a guest passenger, and since there was no attempt to charge defendant with wilful and wanton misconduct, judgment for plaintiff was reversed.

Appeal from Circuit Court of Peoria county; Hon. JOSEPH E. DAILY, presiding. Reversed. Heard in this court at October term, 1939; opinion filed January 8, 1940. Rehearing denied February 6, 1940.
