MODIFICATION OF OPINION AND DENIAL OF PETITION FOR REHEARING

The opinion of this court filed April 19, 2007, in the above entitled case is modified as follows:

1. On page 19, delete footnote 10.

2. On page 17, last paragraph, line 3, change “subdivision (b)(4)” to “subdivision (a)(2)”. Also, in the same paragraph, last line, change “subdivision (b)(3)” to “subdivision (a)(3).”

The modification does not effect a change in the judgment. As modified, the petition for rehearing is denied.
