Action to recover damages for personal injuries sustained by the plaintiff as a result of an alleged battery by the defendant, brought to the Superior Court in the judicial district of Ansonia-Milford, where the Y.M.C.A. of Milford filed a complaint as intervening plaintiff; thereafter, the matter was referred to Laura J. Donahue, attorney trial referee, who filed a report recommending judgment, in part, for the plaintiff and the intervening plaintiff; subsequently, the court, Thompson, J., rendered judgment in accordance with the referee's report, from which the defendant appealed to this court. Affirmed.
