IN THE MATTER OF AMANDA R. COMPTON, PETITIONER-APPELLANT, v. ROBERT R. COMPTON AND ROBBIE G. COMPTON, RESPONDENTS-RESPONDENTS.


PRESENT:

Appellant having moved to vacate the dismissal of the appeal and for assignment of counsel on the appeal taken herein from a decree and order of the Monroe County Surrogate's Court entered in the Office of the Clerk of said court on December 2, 2016,

Now, upon reading and filing the affidavit of Amanda R. Compton sworn to October 31, 2017, the affidavit of William J. Brongo, Esq., sworn to November 1, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal is granted, on the condition that appellant perfects the appeal on or before January 29, 2018, and

It is further ORDERED that the motion insofar as it seeks assignment of counsel is granted to the extent that Paul Watkins, Esq., 115 N. Main Street, Fairport, New York 14450, is hereby assigned as counsel for the purposes of this appeal.
