Appeal, No. 40, Oct. T., 1966, from judgment of sentence of Court of Quarter Sessions of Philadelphia County, Sept. T., 1964, No. 213. Indictment charging defendant with assault and battery, assault and battery resisting arrest, and unlawfully resisting officer in making an arrest. Argued June 14, 1966.
