Indictments charging defendant with rape, possession of an instrument of crime and terroristic threats. Before GUARINO, J., without a jury. Demurrer sustained to charge of terroristic threats and defendant found not guilty of possession of an instrument of crime and guilty of rape. Defendant's motions for new trial and in arrest of judgment denied and judgment of sentence entered. Defendant appealed. Appeal, No. 1982, Oct. T., 1976, from Court of Common Pleas, Trial Division, of Philadelphia, Oct. T., 1975, No. 1600. Submitted December 10, 1976.
