Indictment charging defendant with theft by unlawful taking. Before LIPPINCOTT, II, J., without a jury. Finding of guilty entered. Defendant's motions for new trial and in arrest of judgment denied and judgment of sentence entered. Defendant appealed. Appeal, No. 1360, Oct. T., 1976, from Court of Common Pleas of Delaware County, Dec. T., 1974, No. 1106. Submitted September 22, 1976.
