COMMONWEALTH v. Bolivar SOTO.

MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

Even if the defendant's claims of error have colorable merit, we can confidently conclude his convictions may be affirmed based on the overwhelming evidence of guilt adduced by the Commonwealth.

In addition, we think the reasoning and authorities, particularly Commonwealth v. Carter, 423 Mass. 506 (1996), and Commonwealth v. Durango, 47 Mass.App.Ct. 185 (1999), cited in the Commonwealth's brief, contribute substantially to our affirmance of the defendant's convictions.

Judgments affirmed.
