NON-PRECEDENTIAL DECISION - SEE SUPERIOR COURT I.O.P. 65.37
Appeal from the Judgment of Sentence Entered August 17, 2015
In the Court of Common Pleas of Lycoming County
Criminal Division at No(s): CP-41-CR-0000293-2014 CP-41-CR-0001293-2013 BEFORE: BENDER, P.J.E., PANELLA, J., and PLATT, J. MEMORANDUM BY BENDER, P.J.E.:
Retired Senior Judge assigned to the Superior Court.
Appellant, Da Ran Malik Sears, appeals from the judgment of sentence of an aggregate term of 21 to 50 years' incarceration, imposed after he was convicted, following a non-jury trial, of various offenses, including third-degree murder. On appeal, Appellant challenges the sufficiency of the evidence to sustain his murder conviction, the trial court's denial of his motion to suppress statements he made to another inmate, and the discretionary aspects of his sentence. After careful review, we affirm.
We have reviewed the certified record, Appellant's brief, and the applicable law. Additionally, we have reviewed the thorough opinion of the Honorable Marc F. Lovecchio of the Court of Common Pleas of Lycoming County. We conclude that Judge Lovecchio's extensive, well-reasoned opinion accurately disposes of the issues presented by Appellant. Accordingly, we adopt his opinion as our own and affirm Appellant's judgment of sentence on grounds set forth therein.
The Commonwealth has not filed a brief in this case.
