COMMONWEALTH v. Tahmouress SADEGHI.

MEMORANDUM AND ORDER PURSUANT TO RULE 1:28
The defendant, Tahmouress Sadeghi, appeals from an order denying his second motion for new trial. The defendant was convicted by a jury of armed assault with intent to kill and assault and battery by means of a dangerous weapon causing serious bodily injury. In an unpublished decision pursuant to this court's rule 1:28, we affirmed the defendant's convictions and the denial of his first motion for new trial. See Commonwealth v. Sadeghi, 75 Mass.App.Ct. 1110 (2009).
The defendant now raises fourteen new issues, which are considered waived, and which have been reviewed only to determine whether there exists a substantial risk of a miscarriage of justice. Commonwealth v. Randolph, 438 Mass. 290, 294–295 (2002). No such showing has been made. None of the issues has merit or requires discussion.
Order denying second motion for new trial affirmed.
