MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant, Vincent Ricci, appeals from the denial of his motion to reconsider the denial of his second motion for new trial and second amended motion for new trial. For a history of this case, see Commonwealth v. Ricci, 57 Mass.App.Ct. 155 (2003) (further appellate review denied, 439 Mass. 1102 [2003] ), and Commonwealth v. Ricci, 67 Mass.App.Ct. 1118 (2006).

The defendant did not file a notice of appeal from the denials of the two motions.

We conclude, for substantially the reasons stated in the Commonwealth's brief at pages twelve through nineteen, that the motion judge properly denied the defendant's second motion for new trial and second amended motion for new trial. Hence, the motion for reconsideration was properly denied.

Order denying motion for reconsideration affirmed.
