Appeal, No. 291, Jan. T., 1971, from order of Superior Court, Oct. T., 1970, No. 248, from judgment of sentence of Court of Common Pleas of Lackawanna County, Feb. T., 1954, No. 12(d), in case of Commonwealth of Pennsylvania v. Anthony J. Rembisz. Appeal dismissed.

Same case in Superior Court: 217 Pa. Super. 766.

Indictment charging defendant with burglary. Before CONABOY, J.

Verdict of not guilty of burglary but guilty of attempted burglary, and judgment of sentence entered thereon. Defendant appealed to the Superior Court, which affirmed the judgment of sentence of the court below, opinion per curiam. Appeal to Supreme Court allowed.
