Opinion

No. 10-P-479.

July 18, 2011.

DECISIONS PURSUANT TO RULE 1:28.

Insofar as the orders denying the motion for a new trial and the motion for a required finding of not guilty and a new trial ruled the sentencing was proper on the indictment charging a violation of G.L. c. 269, § 10(a), they are reversed; the judgment on that indictment is vacated, and the case is remanded for a hearing on sentencing at which the defendant shall be present and given the opportunity to be heard. In all other respects, the orders denying the motions are affirmed.
