Indictment charging defendant with rape, sodomy, assault and battery and indecent assault. Before PRICE, JR., J. Appeal, No. 310, April T., 1967, from judgment of sentence of Court of Oyer and Terminer of Allegheny County, Sept. T., 1966, No. 89. Argued April 8, 1968.

Richard F. Pohl, with him Cauley, Birsic Clarke, for appellant; Carol Mary Los, Assistant District Attorney, with her Charles B. Watkins, Assistant District Attorney, and Robert W. Duggan, District Attorney, for Commonwealth, appellee.


Judgment of sentence affirmed and the defendant is directed to appear in the court below at such time as he may be there called, and that he be by that court committed until he has complied with the sentence, or any part thereof which had not been performed at the time the appeal was made a supersedeas.
