COMMONWEALTH v. Christopher GOPAUL.
The judgment on the conviction of assault and battery as a lesser included offense of armed assault with intent to murder a person sixty years or older is reversed, the verdict is set aside, and judgment shall enter for the defendant on that charge. The remaining judgments are affirmed.
