The judgment of conviction on the count of the complaint charging the defendant with a violation of G.L.c. 209A, § 7, is affirmed. On the count of the complaint charging the defendant with assault and battery, the conviction is affirmed, but the sentence is vacated, and the case is remanded to the District Court for resentencing in accordance with the memorandum and order of the Appeals Court.
