MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant contends that he received ineffective assistance of counsel under Padilla v. Kentucky, ––– U.S. ––––, 130 S.Ct. 1473, 176 L.Ed.2d 284 (2010), in entering his guilty pleas on December 10, 1993, and that his postconviction counsel below was ineffective for failing to create an adequate record to support this claim. This case is controlled in all material respects by Commonwealth v. Clarke, 460 Mass. 30, 949 N.E.2d 892 (2011).

Order denying motion for new trial affirmed.
