Indictments charging defendant with robbery, criminal conspiracy, and simple assault. Before MARUTANI, J. Demurrer sustained to charge of assault and verdict of guilty of robbery and not guilty of remaining charges and judgment of sentence entered. Defendant appealed. Appeal, No. 901, Oct. T., 1978, from Court of Common Pleas, Trial Division, of Philadelphia, Oct. T., 1976, No. 530. Argued September 11, 1978.
