From The Court of Appeals of Virginia.

Victoria Johnson (Office of the Attorney General) for appellant.

Bradley R. Haywood and Kevin Tamul (Office of the Public Defender) for appellee.

GRANTED APPEAL SUMMARY

Assignments of Error

I. The Court of Appeals erred in vacating Canales's sentences in Court of Appeals Record Number 1037-22-4.

II. The Court of Appeals erred in determining that Canales's probation violations constituted two single courses of conduct, in incorrectly defining "single course of conduct," and in failing to defer to the factual findings made by the circuit court.

III. Even if this Court determines that the Court of Appeals' definition of "single course of conduct" was not error, then the Court of Appeals erred in its application of its definition by finding two technical violations and not three, and erred in not deferring to the factual findings made by the circuit court.
