No. 822 MAL 2004, Petition for Allowance of Appeal from the Order of the Superior Court.


ORDER


AND NOW, 1st day of February 2005, the Petition for Allowance of Appeal is GRANTED to address the following issues:

Whether the U.S. Constitution requires issuance of a cautionary instruction when evidence of a co-conspirator's guilty lea is introduced at trial; and

If the answer to the first question is yes, whether the absence of such an instruction in this case was harmless error.
