Indictments charging defendant with burglary, aggravated assault and simple assault. Before DURHAM, J. Demurrer sustained to charge of aggravated assault and verdict of guilty entered as to burglary. Defendant's motions in arrest of judgment and for new trial denied and judgment of sentence entered. Defendant appealed. Appeal, No. 1534, Oct. T., 1976, from Court of Common Pleas, Trial Division, of Philadelphia, Dec. T., 1975, No. 1216. Submitted September 13, 1976.
