Opinion

No. 14574.

June 8, 1981. En Banc. Rehearing Denied July 15, 1981.

Appeal from the Fourth Judicial District Court, Parish of Ouachita; John R. Joyce, Judge.

Johnson, Johnson Johnson by Don H. Johnson, Monroe, for defendant-appellant, State of La. through Department of Highways.

Thomas V. Gardner, Jr., Asst. City Atty., for defendant-appellee, City of Monroe.

Rankin, Yeldell, Herring Katz by Alex W. Rankin, Bastrop, for plaintiff-appellee, Sue Combs.

Before HALL, JASPER E. JONES and FRED W. JONES, Jr., JJ.

This suit was consolidated with Garrison v. State of Louisiana, through the Department of Highways, et al., 401 So.2d 528 (La.App. 2d Cir. 1981), for trial purposes. The trial court rendered separate judgments in the consolidated cases. We considered the three suits together and gave our reasons for judgment in all three cases in Garrison, supra. For the reasons assigned in that opinion rendered on this date, we affirm the judgment of the trial court in this case, at appellant's cost.
