Indictment charging defendant with attempted burglary and unlawful possession of instruments of crime. Before FOREMAN, J., without a jury. Finding of guilty and judgment of sentence entered. Defendant appealed. Appeal, No. 381, April T., 1976, from Court of Common Pleas of Blair County, No. 872 of 1975.

John Woodcock, Jr., Public Defender, for appellant. No appearance entered nor brief submitted for Commonwealth, appellee.


Appellant's conviction is affirmed per curiam. The case is remanded for resentencing on charge of possession of instruments of crime, 18 Pa.C.S.A. § 907, within lawful limits, 18 Pa.C.S.A. § 1104 (1).
