No. 507 WAL 2001, Petition for Allowance of Appeal Request for Appointment of Counsel.


ORDER


AND NOW, this 14th day of November 2001, as it appears that at trial and on appeal Petitioner was represented by appointed counsel and that Superior Court affirmed the judgment of sentence, and because Pa.R.Crim.P. 122(C)(3) [formerly 316(c) (iii)] provides that "Where counsel has been assigned, such assignment shall be effective until final judgment, including any proceedings upon direct appeal" (emphasis added), Petitioner's appointed counsel is directed to proceed in accordance with the Rule. See Commonwealth v. Daniels, 420 A.2d 1323 (Pa. 1980); Commonwealth v. Hickox, 249 A.2d 777 (Pa. 1969).

The Prothonotary is directed to forward to counsel Petitioner's pro se "Petition for Writ of Certiorari En Banc". The Petition for Allowance of Appeal shall be filed within forty-five days of the date of this Order.
