Appeal, No. 1482, Oct. T., 1974, from judgments of sentence of Court of Common Pleas of Huntingdon County, No. 281 of 1969, and 127 of 1970, in cases of Commonwealth of Pennsylvania v. Robert O. Patterson. Judgment of sentence at No. 281 of 1969 affirmed; judgment of sentence at No. 127 of 1970 reversed.

Indictment charging defendant with sodomy and assult and battery. Before TERRIZZI, P.J., without a jury.

Finding of guilty and judgment of sentence entered thereon. Defendant appealed, nunc pro tunc.

Indictment charging defendant with sodomy, furnishing intoxicating beverages to a minor and corrupting the morals of a minor. Before TERRIZZI, P.J.

Verdict of guilty and judgment of sentence entered thereon. Defendant appealed, nunc pro tunc.

The judgment of sentence imposed by the Court of Common Pleas of Huntingdon County at No. 281, Criminal Action, 1969, is affirmed. The judgment of sentence by the Court of Common Pleas of Huntingdon County at No. 127, Criminal Action, 1970, is reversed on the basis of Wardius v. Oregon, 412 U.S. 470 (1973); Commonwealth v. Jackson, 457 Pa. 79, 319 A.2d 161 (1974); and Commonwealth v. Contakos, 455 Pa. 136, 314 A.2d 259 (1974).
