ORDER


AND NOW, this 8th day of November, 2007, the Berks County Common Pleas Court is directed to conduct a hearing to determine whether Gresh waived his right to counsel on direct appeal to the Superior Court and, if so, whether Gresh's waiver of his right to counsel was knowing, intelligent and voluntary pursuant toCommonwealth v. Grazier, 713 A.2d 81 (Pa. 1998). Should the common pleas court determine that Gresh had not waived his right to counsel, or that Gresh's waiver of his right to counsel on the day he was convicted was not knowing, intelligent and voluntary, the common pleas court is directed to appoint counsel to represent Gresh for the purposes of filing a petition for allowance of appeal. The petition for allowance of appeal is to be filed within sixty (60) days of the entry of an order appointing counsel.
