ORDER


AND NOW, this 14th day of September, 2007, this Court entered an order on May 15, 2007, granting Petitioner's Request For Leave To File an Allowance of Appeal Nunc Pro Tunc and directed Nicholas C. Stroumbakis, Esquire, court appointed counsel, to file a petition for allowance of appeal within 45 days of the date of the order. Since Attorney Stroumbakis failed to file the petition for allowance of appeal, he is removed as counsel for the Petitioner and the matter is remanded to the Court of Common Pleas of Berks County, Criminal Division, at No. 6118-2004 for the appointment of counsel. New counsel is directed to file a petition for allowance of appeal within 45 days of the date of the appointment by the common pleas court.
