Motion for permission to proceed as a poor person and for assignment of counsel. It appears that the claim arose in Cayuga County, which is within the jurisdiction of the Appellate Division, Fourth Department.

Upon the Court's own motion, it is

ORDERED that the appeal and the motion is transferred to the Appellate Division, Fourth Department, for hearing and determination (see Court of Claims Act § 24).
