Collins v. Win-Holt Equipment Corp.

Appellate Division of the Supreme Court of New York, Second Department
Jun 4, 1998
251 A.D.2d 363 (N.Y. App. Div. 1998)

Opinion

June 4, 1998

Appeal from the Supreme Court, Rockland County (Weiner, J.).

Ordered that the order is affirmed insofar as appealed from, with costs.

The Supreme Court did not improvidently exercise its discretion in denying that branch of the plaintiff's motion which was to sever the third-party action (see, Shanley v. Callanan Indus., 54 N.Y.2d 52).

Rosenblatt, J. P., Sullivan, Altman and Luciano, JJ., concur.
